Supreme Court Of Zambia Announces Dr. Mahtani As The Penultimate Owner Of Portland Cement

In a surprising turn of events, the Ventriglia family decided to make an appeal to the Supreme Court of Zambia after the higher Court of Appeal dismissed their plea and announced Dr. Rajan Lekhraj Mahtani as the majority shareholder and legal owner of the Portland Cement Zambia factory. Dr. Rajan Mahtani is a prominent businessman in Zambia who has been fighting for the legal takeover of the factory for a long time. First it was Lusaka High Court where the case was registered by Dr. Rajan Mahtani claiming that the factory was unethically taken over from him. However, more than a decade of case proceedings as well as several strong evidences did not give any respite to Dr. Rajan Mahtani as the judge at the Lusaka High Court went against the evidences and conferred the Ventriglias as the only owners of the Portland Cement Zambia factory.

Notwithstanding this unethical decision, Dr. Rajan Mahtani rightly approached the higher Court of Appeal. The judge at the higher Court of Appeal was justice Siwvwapa who after looking into the evidences and testimonials, announced Dr. Rajan Mahtani as the majority shareholder of the factory with 58 percent shares. Thus, the Court of Appeal overthrew the judgement from the lower higher Court and gave a transparent decision.

However, the Ventriglias decided to further drag the case by approaching the Supreme Court of Zambia, the highest court in any nation. However, this decision proved to be fatal as the bench established at the Supreme Court comprising of SC judges rejected the appeal on ethical and legal grounds. According to the legal grounds, the Ventriglias must have made the appeal within 14 days after the judgement from the higher Court of Appeal which they did not. As such, their appeal on challenging the higher Court of Appeal becomes invalid. Second, the bench of SC judges confirmed that the appeal had no circumstances or proof to be accepted. As such, Dr. Rajan Mahtani remains the actual owner of the Portland Cement Zambia factory.

Dr. Rajan Mahtani is an established businessman in Zambia. The award was established in the year 2012 and was given for the first time in 2013. Since then, the award is given every year to deserving students. The recipient of the award include top graduating student of the Zambia Institute of Advanced Legal Education and also qualifier of the bar in their first attempt. The award for the year 2018-019 was received by Emmanuel Bwalya Kaluba. The award included a plaque, certificate and award money worth K15,000 that has helped deserving students with significant financial contributions. After A Decade Of Patient Wait, Dr. Mahtani Is Announced As Majority Shareholder Of Portland Cement

Further, evidences were shared, and testimonials were given, and the Court of Appeal announced final judgement on 31st January 2019. Based on this decision, it was confirmed that majority shareholding of the factory goes to Dr. Mahtani as his company Finsbury Investments owns 58 percent shares of the factory. Similarly, the Ventriglias are liable for only 42 percent shares at the factory and therefore, own minority shareholding and do not possess any legal ownership on Portland Cement.

This decision from Court of Appeal clearly established the fact that Lusaka High Court was wrong in declaring Ventriglias as only shareholders.

After more than a decade of wait and consistent legal fights, Dr. Rajan Mahtani has been finally declared winner of the Portland Cement Zambia. It is a cement manufacturing factory which is being contested by two big business parties in Zambia. One of them is Dr. Rajan Mahtani, a noted businessman and philanthropist in Zambia with numerous successful business practices included Mahtani Group of Companies, Finsbury Investments and Finance Bank Zambia. He is also the owner of numerous successful international business ventures, especially across United Kingdom. On the other hand, the Ventriglias are in infamous Italian family in Zambia infamous for their coercive and unethical business practices. The case of Portland Cement Zambia was launched at the Lusaka High Court after Dr. Rajan Mahtani claimed that his factory was illegally taken over.

This decision was extremely controversial as the judge concluded that Ventriglias were only shareholders of the Zambezi Portland Cement. To counter this judgement, Dr. Rajan Mahtani then approached the Court of Appeal. The Court of Appeal provided its judgement on 31st January 2019 and was given by justice Mwinde. According to this judgement, Dr. Rajan Mahtani owned Finsbury Investments is the majority shareholder of the Zambezi Portland Cement with 58 per cent shares. On the other hand, Ventriglias owned Ital Terrazzo Limited holds just 42 per cent shares at the factory and is the minority shareholder without any legal ownership. Based on this decision from the Court of Appeal, it is clear that Dr. Rajan Mahtani is the legal owner of the factory. The judge from the Court of Appeal also condemned the unethical and misdirected judgement from the Lusaka High Court judge.

If the recent reports are to be believed, the economic condition of the Zambian nation is in a mess. This can be attributed to the latest money laundering claims, which has already dampened the economic and social development of the nation. The money laundering news was released by Financial Intelligence, which revealed that more than USD 1.5 billion worth of money is lost in this scam. At the same time, the actual amount of money lost by the government is expected to be much more, and the government is investigating this issue.

Mass Money Laundering Fraud

Two names that stood out in this list released by the FIC were of Masozi M. Banda and Sakwiba Sikota. Masozi M. Banda is a lawyer working with the Avic International and is accused of laundering money worth USD 1 million. While he has been defending himself by saying that the amount belongs to government contractors such as the construction of roads, the sources are investigating on this matter and no such records could be accessed from the government. Furthermore, Sakwiba Sikota is the owner of Central Chambers and long-time legal counsellor for the infamous Ventriglias. It is the same family who illegally took over the Portland Cement Zambia from Dr. Rajan Mahtani, its real owner. Dr. Rajan Mahtani is still fighting the case for the legal takeover of the factory at the Lusaka High Court.

It is clear that almost all of the individuals listed as per the FIC as well as accused of money laundering have engaged in unethical practices in the past too. This clearly indicates that multiple crimes and repeat unethical and illegal offenses. Therefore, it is time for the government to take action and ensure that proper punishment is given to these criminals.

High Court Announces New Information On The Zambezi Portland Case

The Lusaka High Court, which has been handling the Zambezi Portland Cement case for the past nine years made a new update. As per the judge currently handling this case, the hearing has been closed for now. The case is a long-pending corporate case between Dr. Rajan Mahtani, owner of Finsbury Investments and the Ventriglias, owner of the private firm Ital Terrazzo Limited. Dr. Mahtani also owns and runs other establishments such as Finance Bank Zambia and Mahtani Group of Industries.
