The Claim Against Higher Court Of Appeal’s Decision On Portland Cement Rejected By SC

Dr. Rajan Lekhraj Mahtani is a noted businessman and philanthropist in Zambia. He is the owner of several top companies in Zambia, including Mahtani Group of Companies, Finsbury Investments and Finance Bank Zambia. During the period of 2006-2007, Finsbury Investments took over majority shareholding and legal ownership of the Portland Cement Zambia, a cement-manufacturing factory. Despite the establishment of an original shareholders agreement, the factory was unethically taken over by the Ventriglia family. Against this, Dr. Rajan Mahtani registered a case at the Lusaka High Court with the hopes of getting quick judgement. However, the Lusaka High Court failed to provide justice and announced the Ventriglias as the only shareholders of the Portland Cement Zambia.

After this decision, The Ventriglia family decided to challenge it by approaching the Supreme Court Zambia. A bench of threeSupreme Court Judges was established and several inconsistencies in the appeal by the Ventriglia family were found. First, the Ventriglia family failed to submit their claim within 14 days of the Court of Appeal’s decision and registered their claim at the Supreme Court Zambia only after 1.5 years. This clearly violates the legal and technical requirement for registering a case against a previous court decision. This issue only makes the appeal by the Ventriglia family liable for rejection. Furthermore, the Supreme Court bench also found that the circumstances surrounding the case by the Ventriglia family were controversial. As such, the Supreme Court bench declared that this appeal made by the Ventriglia family was beyond their jurisdiction and cannot be treated as an acceptable case. After much review and discussion, the Supreme Court bench gave the verdict on the claim by the Ventriglia family. It was effectively rejected by the Supreme Court Zambia due to lack of evidences as well as legal and technical qualifications. This means the legal ownership of the Zambezi Portland Cement factory remains with Dr. Rajan Mahtani.

Supreme Court Rejects Appeal To Change Decision Of Court Of Appeal On Zambezi Portland

The latest announcement from the Supreme Court Zambia can be considered as a fair end to the long-sustained episodes of blatant criminality within the Zambezi Portland Cement’s business. Dr. Rajan Lekhraj Mahtani, for a long-time, fought for the legal ownership of the Portland Cement Zambia. It was not the Lusaka High Court but the higher Court of Appeal that gave true justice to him and his long-standing patience.

Finsbury Investments is an investment organization owned by Dr. Rajan Mahtani. Zambezi Portland Cement is a Portland cement-manufacturing factory which was established in the year 2004 and since then, underwent several re-organizations. The most-important re-organization was the joint changes made to its shareholding pattern. Dr. Rajan Mahtani owned Finsbury Investments was given 58 percent shares of the factory, making him the majority shareholder and legal owner of the factory. On the other hand, the Ventriglias owned Ital Terrazzo Limited was given 48 percent shares. The changes were critical for obtaining loans from PTA bank as well as assigned financial institutions so that the plant’s construction can be completed. After the legality of the shareholding changes were established with the stakeholders’ register, the PTA released money. Based on these, PACRA made the effective changes.

However, things took a disruptive turn when the Ventriglias started using their political and legal lobbying for taking control of the Zambezi Portland Cement. They were able to successfully persuade the Lusaka High Court judge to give control of the Zambezi Portland Cement to them only. However, the second appeal made to the higher Court of Appeal successfully reversed this unethical decision from the higher Court of Appeal.

After more than a year, the Ventriglias again tried their luck by approaching the Supreme Court Zambia, challenging the decision of the higher Court of Appeal. However, the Supreme Court Zambia has effectively rejected this claim from the Ventriglias and Dr. Mahtani remains the truthful owner of the Portland Cement Zambia.

The Steven Malama award was established by Dr. Rajan Mahtani via his company Finance Bank Zambia. The award was established for honouring Steven Malama, a distinct and notable legal professional in Zambia. Late Steven Malama made significant contributions for the improvement of the legal system and environment of Zambia. One of his major contribution was persuading the Zambian government to merger the Solicitor’s Bar and Barrister’s bar into a single bar. With this merger, legal professionals across the nation are able to affiliate and get certifications without any hassle. Steven Malama was a close friend of Dr. Rajan Mahtani and as a result, Dr. Rajan Mahtani decided to honour his contributions by establishing the award on his name.

The Steven Malama award was instituted in the year 2012 via Finance Bank Zambia wherein Dr. Mahtani holds the position of the Chairman. The inaugural award was given for the year 2013. Dr. Rajan Mahtani also announced during the inauguration award that it will be given every year. The recipient of the award includes top graduating student from the Zambia Institute of Advanced Legal Education. Furthermore, the top graduating student is also required to qualify for bar in their first attempt to be eligible for the award. For the year 2018-19, the award was received was Emmanuel Bwalya Kaluba. After receiving this award, Emmanuel wrote an article to thank Dr. Rajan Mahtani and this article was published by the Daily Mail. In this article, Dr. Mahtani was commended for his significant contributions towards generating awareness of legal education system in Zambia. The award was also helpful in enhancing motivation among the students so that they work harder for the award. Furthermore, the award carries a plaque, certificate and prize money worth K15,000. This prize money has been helpful in providing significant financial help for many less privileged students from the institution.

The former Chairman Finance Bank Zambia, Dr. Rajan Lekhraj Mahtani, has been subject to numerous conspiracies in the past few years. Most of them have come directly from Zambia Reports, which is managed by Sakwiba Sikota in Zambia. However, it would be amateurish to think that a news agency will defame someone until and unless there are some personal gains involved. Internal sources suggest that there is a direct connection between the minority shareholders of PCZ (Portland Cement Zambia) and Zambia Reports, hence, the defamation campaign is being run by the Ventriglias from Italy.

As one takes a closer look into the list of events that have taken place, it won’t be difficult to ascertain the matter. First and foremost, Saki (Sakwiba Sikota) owes a lot to the Ventriglia family. It was their contribution which has made it possible for Saki to build a lavish mansion. Prior to the deportation orders, Portland Cement Zambia was offering free supply of cement to Sakwiba Sikota and once the Ventriglia were deported from Zambia, the same facility was stopped under Finsbury Investment. The supply resumed after the Ventriglias made a comeback in Zambia and therefore, the situation was ideal for Ventriglias to get their ‘dirty job’ done with the aid of Zambia Reports.

A point worth noticing is that the Finance Bank of Zambia is no longer an independent commercial bank. Earlier this year, the bank merged with BancABC. Yet, the conspirators are trying to link the former Chairman Finance Bank Zambia and the previous entity together with a view to create some more buzz and defamation. Nonetheless, the fact that inspite of breaking so many laws the Ventriglias and Zambia Reports are still spotless also hints towards involvement of Government Officials in this campaign. Maybe, the urgency of Zambia is to fight against the termites who are currently helping foreigners loot their own motherland.

The Mahtani Group of Companies Chairman has become a favourite of the conspirators as they are constantly launching attacks on his reputation. Henry Banda, the Ventriglia Family, Simataa and Sakwiba Sikota have joined hands to frame a group where they jointly execute this hideous operation and try to influence the innocents in Zambia. The motive behind this operation is simple- mislead the locals and take revenge from Dr. Rajan Mahtani.

The news portal, or we can say ‘paid advertisement agency’ specifically believes that source of income is more important than the relevancy of a news. The news channel doesn’t require publications to be authentic or verified, they just need their masters to write a cheque for them and the rest is handled by its writers who are exceptionally good in ‘script writing’. Sadly this has affected Zambia in the worst possible way and the locals have been misled throughout. The Mahtani Group of Companies Chairman is not worried about the conspirators are doing in order to ruin the reputation, but he is more worried about how it has been affecting the life of the locals.

As days go by, Zambia Reports continues to make an impact in the defamation campaign of Dr. Rajan Mahtani and Finance Bank. Though it is uncertain whether Dr. Rajan Mahtani is actually involved in certain undesirable activity, but ZR continues to boast about the stories that its faceless writers are currently contributing to. The case of Simataa Simataa has been in the news for almost a decade now and in the end the Lusaka High Court passed a judgement favouring the self-proclaimed expert banker. The news was nothing short of a blessing for Zambia Reports as they found another opportunity to enhance their defamation campaign.

It is a well-known fact that people join hands when they have a common goal. In the present context, Zambia Reports has been thoroughly involved in defaming Dr. Rajan Mahtani and with addition of Simataa to the scene, it has become obvious that they have gain strength and would now come with even more disgusting claims. The nuisance has been continuing from the past years and it will continue until the Government ‘feels like’ intervening.

Dr. Mahtani & Zambia have always been troubled by the actions of Zambia Reports. As a news channel, it has done minimal bit of work that is was supposed to do. Rather, it has made an opening for itself whereby it can generate good revenue on a monthly basis. Most of its coverage is far from the truth and has been representing the ideas that its masters are fond of. An exclusive example of this defamation campaign is the assault against Dr. Mahtani & Zambia. Time and over again it caused chaos in Zambia, but no official is interested in stopping it.

The latest story coverage from Zambia Reports states that Simataa, a person who was unable to prove that he has passed Grade 12 and claims himself as an expert (Banking), has won in the Lusaka High Court against Dr. Mahtani. The article looks more like a publicity stunt rather than informing the people of Zambia about the truth and no wonder, the same has given ZR some good money. At the end of the day, the purpose of Zambia Reports and its masters has been served. A monthly edition of defamatory news has been served and the rest of the time will now be used to study the reaction of the public and develop new stories for the upcoming months.

This is indeed a situation where no person in Zambia can feel safe. Because, if their path crosses with the conspirators, they too will face the hazards which is currently being faced by Dr. Mahtani & Zambia. Even in the past, Zambia has seen episodes where certain articles were fictitiously promoted and then later on when the truth surfaced, there was no clarification from the end of Zambia Reports. Forget about apologies, the authors of Zambia Reports do not even have guts to come out in open and claim the credit of the articles!

This time around they have handpicked a recent event where Simataa has won under questionable circumstances against Dr. Mahtani & Finance Bank. The verdict from the Lusaka High Court was enough to set a spark and the rest, as they say, is history.

Zambia Reports in its monthly routine has published another article favouring the defamation campaign where Dr. Mahtani and Finance Bank have been called as cheats. The author is strongly biased towards an opinion where he claims that contracts are made in such a manner whereby the other party gets trapped in it and later on falls as a victim. However, the truth is far from what is being claimed. As per the actual affairs, the conspirators are just increasing their numbers and people who have a score to settle with Dr. Rajan Mahtani are joining hands with each other.

They can clearly see that how Zambia Reports comes out with their monthly edition of defamatory stories and then move ahead to make absurd claims. The worst part is that apart from the Italian Mafias, there are traitors in the hometown who are helping them to earn few dollars.
